Work Contracts

Work contracts are generally offered by the employers for whom you are going to work. In order to have the same working rights as a Spanish employee, the contract must be at least 6 months long. However, temporary contracts are offered for as low as 3 months or as long as 9 months.

These days, seasonal work is also on the rise in the coastal areas of Spain. During the months of May to September, the coastal areas see a boom in employment opportunities at hotels, clubs, bars and restaurants. So, it’s basically like you can work in the day and then enjoy your night life with your own earned money.

The standard working week in Spain is of 40 hours and the daily working hrs is limited to 9 hrs work per day. Work hours in Spain include a siesta (which is a 2 - 3 hour break in the afternoon). Employees can also work Overtime in Spain but can never exceed 80 hours in a year. Overtime is paid at the normal rate plus a minimum of 75% of the normal hourly rate.

There are a total of 14 national holidays in Spain and a total of 30 calendar days “vacation period” is paid by employees.

The most common types of employment contract are as follows:

• Contracts for indefinite duration:
   o Full time contract.
   o Part time contract
• Temporary contracts.
  o Training contract.
  o Learning contract.
  o Contracts for production needs.
o Contracts for the provision of a specific service or the completion of a specific work.
o Contracts for the replacement of employees.

Remember that the work contract can be ended in between if the Employer decides to dismiss you from the service. You will then have 20 days o request for a mutual agreement with the employee. If this is not possible, then you can file a case in the Labour Court. If the court agrees to your side of the story and feels that your removal was unjustified, then you will be granted 45 days of compensation for every year worked with the employer.
